18. Tutor Status and Compliance
Twoition Ltd engages tutors primarily as independent, self-employed contractors, not as employees or agents of the Company.
All tutors are contractually required to:
● Comply with the Company’s Safeguarding and Child Protection Policy, Data Protection and Privacy Policy, and Code of Conduct.
● Maintain valid safeguarding and DBS certification.
● Deliver tuition in accordance with the professional standards expected by Twoition Ltd.
● The Company may suspend or terminate a tutor’s engagement if these standards or policies are breached.
Where a Company employee or director also delivers tuition, they are bound by the same safeguarding, confidentiality, and conduct requirements as all tutors. Their employment status remains separate from contractor engagements.
18a. Regulatory Compliance as an Education Employment Business
Twoition Ltd operates as an education employment business in accordance with the Employment Agencies Act 1973 (the Act) and the Conduct of Employment Agencies and Employment Businesses Regulations 2003 (the Conduct Regulations).
We ensure that our recruitment, placement, and engagement of tutors comply with all statutory obligations under these regulations, including:
● Maintaining transparency in tutor placements and contractual relationships;
● Ensuring that tutors are suitably vetted, qualified, and compliant with safeguarding and right-to-work requirements;
● Operating fair and lawful terms of engagement for tutors and clients; and
● Adhering to all relevant record-keeping, data protection, and professional conduct standards as required by law.
● Where tuition is provided in collaboration with third-party agencies, Twoition Ltd ensures such partners also operate in compliance with the Employment Agencies Act 1973 and Conduct Regulations 2003
19. Third-Party Tutors and Partner Agencies
- Twoition Ltd may, from time to time, collaborate with trusted third-party tutoring agencies or partner organisations to provide tuition services when appropriate.
- In such cases, the tutor may be engaged or employed by that third-party provider rather than directly by Twoition Ltd.
- Twoition Ltd may receive or pay a commission or referral fee as part of this arrangement. This does not affect the total amount payable by the client unless otherwise stated.
- Clients will be informed when a tutor is provided through a third-party agency. All such tutors will be subject to the same safeguarding, vetting, and quality assurance standards as those directly engaged by Twoition Ltd.
- Twoition Ltd remains responsible for ensuring that all partner agencies comply with relevant UK legislation, including safeguarding, data protection, and professional conduct requirements.
- Where a tutor is contracted through a third-party agency, that agency may retain responsibility for the tutor’s employment terms, payments, and insurance. Twoition Ltd accepts no liability for matters arising from the agency’s direct contractual relationship with its tutors.
